Three players not charged in the infamous Duke lacrosse case filed a lawsuit against Duke University, top administrators, fallen prosecutor Mike Nifong, the city and a long list of others,

The suit, filed by Breck Archer, Ryan McFadyen and Matt Wilson, is the latest in a string stemming from the university’s handling of an escort service dancer’s unfounded allegations that she was gang-raped at a lacrosse team party in March 2006.

In the 400-page complaint, Robert Ekstrand, the Durham lawyer representing the players, lists 35 causes of action that range from negligent infliction of emotional distresss and fraud.

Seriously - shouldn't we reserve judgement until we see 1. the merits of the complaint (no details in the article), and 2. what they are asking for?

(At a minimum, McFayden should never have been suspended.)

This is not uncommon. Lawyers refer to this as the kitchen sink method - i.e. throw the kitchen sink and see what sticks. It seems excessive, but it is really not all that uncommon to see this kind of complaint.

Hmmm. I beat myself up all the time. Then again, maybe that's because I was raised Catholic...

I have not read the complaint, only media coverage. I am also not a lawyer.

In one way I am glad the complaint was filed. While there may be many reasons to settle a case, one is certainly to avoid discovery. By settling previous suits Duke has avoided explaining the decisions that were made by Brodhead and others. Personally I think that alumni and other supporters of the school should hear just what Duke did and why. This is probably the most media covered event is school history and I still think that things have been covered up.

On the other hand, Duke should be moving forward. By settling cases Brodhead avoids a long legal process that will tie up the time and talents of many senior officials. On the athletic front we have a basketball team playing exciting "Duke" basketball and have just made a promising hire for football coach. I am sure that there is progress in other areas that do not get the public exposure. It would be nice if this case was only in our rear view mirror.

Lastly, if you read the complaint remember that it is only one side.

Given that Tara Levicy, the SANE nurse, has not been punished by anybody else, I am certainly glad that the suit includes her, bless her lying little heart.

This is the part of the suit regarding Levicy. Without her fabricated story, the prosecution had absolutely nothing in the way of evidence.
